  1. How long do I have to be living apart from my spouse before I qualify for a divorce?
    The Act requires that you be living apart from your spouse for a period of at least 4 of the preceeding 5 years. Living apart does not always mean in separate houses.

  2. Do I need a Separation Agreement?
    No. However if you do have one the Courts can grant you a divorce on the same terms of the Separation Agreement but can change the terms. See Factors considered by Courts

  3. Do I need my spouse's consent to apply for a divorce?
    No

  4. Can I proceed even if I dont know of my spouse's whereabouts?
    Yes. This will require additional documentation which Divorce Ireland will provide.

  5. How much will it cost?
    Divorce Ireland's charges are €550.00 inclusive of VAT. Special discounts are available in certain circumstances and the charges can be paid over the period of instruction to provision of the last documentation. Please contact us for details.
